If you are thinking about starting a nonprofit, don't miss this step-by-step guide from corporate tax attorney Cherie Evans on the legal aspects of setting up and running a charitable organization. Along with clear tax benefits, there are forms to file, rules to follow, and records to keep. How do you obtain public charity status? What are the pros and cons? Are there other options? This workshop will answer your questions.

A clear definition of terms is needed when navigating the complex rules and regulations governing nonprofit organizations. Evans begins with an overview of the various types of associations, trusts, nonprofit and public benefit corporations that may be considered depending on the goals and scope of a group's mission. Charitable organizations are most commonly recognized by their 501(c)(3) federal tax status, but various state laws also have much to say concerning the foundation and governance of various charitable and tax exempt entities.

Evans walks through the steps of forming a nonprofit, from filing Articles of Incorporation to writing bylaws to finding the right forms to qualify for federal and state tax exempt status. Nonprofits must follow exacting rules of corporate governance which include keeping proper records and publishing regular financial reports. Protecting the benefits of 501(c)(3) status means watching out for risks that might raise concern with the IRS such as improper board compensation, self-dealing, or excessive lobbying. Evans closes with a comparison of public charities and private foundations, and some alternatives to nonprofit status that might be easier to deal with but still help an organization achieve their charitable goals.
